Patient Referral Program Terms and Conditions

  1. Eligibility.
    This gift card referral program (the “Referral Program”) is offered to legal residents of the fifty (50) United States and the District of Columbia except for residents of Massachusetts, Michigan, Minnesota and Rhode Island (the “Territory”) who are eighteen (18) years old or older at the time of entry and who are not: (i) employees of Align Technology, Inc. or its affiliates or subsidiaries (“Align”) or their immediate family members (i.e. spouse, parent, child, sibling or the ‘steps’) or persons living in the same household; or (ii) Invisalign providers, their partners, employees and contractors, or any of their immediate family members.

  2. Definitions.

    1. Referrer. A “Referrer” is a current or past patient of Invisalign clear aligner treatment who maintains a patient account on the My Invisalign App, meets the further eligibility requirements described below, and initiates a referral by sending an invitation link from the My Invisalign App to a qualified Recipient.

    2. Recipient. A “Recipient” is an individual who has not yet started Invisalign clear aligner treatment or created a patient account on the My Invisalign App, who has not already received a referral gift card for this program from a Referrer, and who meets the further eligibility requirements described below. Downloading and registering a general user account on the My Invisalign App does not disqualify an individual from later becoming a Recipient.

  3. Requirements.
    For either the Referrer or the Recipient to be eligible to receive a gift card under this Referral Program, all of the following criteria must be met:

    1. Referrer treatment. The Referrer must be a current or prior Invisalign clear aligner treatment patient with an existing patient account on the My Invisalign App.

    2. No retroactivity. The Recipient must receive the referral email (including the referral link) from the Referrer before the date on which the Recipient’s aligners are shipped to the Recipient’s treating doctor (as indicated by the date on the aligner shipping invoice). The Referral Program may not be applied retroactively.

    3. Successful activation. Once the Recipient has received their clear aligners from the treating doctor, the Recipient must use the referral link that was provided to the Recipient in the original referral email from Referrer to create the Recipient’s patient account on the My Invisalign App. Creating a patient account requires an individual to share treatment information on the My Invisalign App under the My Invisalign App terms and conditions. Patients who do not wish to create a My Invisalign App patient account are not eligible for the Referral Program.

    4. Recipient limit. The Recipient may not have previously claimed a gift card under this Referral Program through a separate referral email.

    5. Transition to Referrer status. A Recipient will be eligible to become a Referrer under this Referral Program as soon as the Recipient’s Invisalign treatment has been validated following creation of a patient account on the My Invisalign App.

  4. Restrictions.

    1. Aligner treatments only. The Referral Program is offered solely to Recipients who will become Invisalign System clear aligner patients, not to Invisalign retainer, Vivera retainer, palatal expansion or other patients or consumers, or for any other or future products unless specifically designated as included in this program.

    2. Prohibited payments. Upon Align’s determination that a participating individual resides in or receives treatment in any of the states excluded from the Territory, does not meet the age eligibility requirement, or is otherwise prohibited from receiving compensation under the Referral Program terms, Align may, in its sole discretion, refuse to issue a gift card to that individual, whether or not the individual has otherwise satisfied the requirements set forth in these terms for receipt of a gift card.

    3. Recipient limit. Offer limited to one gift card per Recipient (regardless of the number of referral emails received from different Referrers). However, a Recipient who becomes a Referrer is entitled to earn additional gift cards up to the total limit set forth below.

    4. Total limit. Each participant is entitled to up to a maximum of five total gift cards per year (one as a Recipient plus four as a Referrer, or five as a Referrer only).

  5. Reporting obligation. Gift cards and other promotional consideration and payments received from Align may be considered taxable income by the relevant taxing authority(ies). A participant is responsible for reporting this income to taxation authorities, whether or not Align provides the participant with a tax form or other documentation related to those contributions. Participants are responsible for their compliance with all applicable tax laws.

  6. No endorsement.
    This Referral Program does not constitute an endorsement or recommendation of any doctor or treatment plan.

  7. Submissions.
    Align is not responsible for late, lost, stolen, misdirected, illegible, incomplete claims/requests or any printing, human, computer, or other errors. Nonconforming submissions may not be processed. Align reserves the right to request additional information from participants in order to verify their eligibility.

  8. Referral program changes.
    Align may modify, cancel, or limit this program at any time.

  9. Third party terms.
    The redemption process for gift cards will be managed and governed by Tango® (or any another third-party vendor(s) chosen by Align) and their applicable terms and conditions. Individual gift cards may be subject to additional third-party terms and conditions. Referral Program participants are subject to and responsible for reviewing and complying with all applicable third-party terms. Your participation in this Referral Program (for example, by issuing a referral email or by accepting a gift card) constitutes your acceptance of all applicable terms and conditions.
